“As of January 1, 2015, under the Fair Labor Standards Act, all homecare agencies nationwide must pay overtime to caregivers for all work above 40 hours in a week. Although the federal Department of Labor announced that it wouldn’t enforce this rule for the first six months of 2015, the real danger is from caregiver lawsuits which will not be barred. Thus, all agencies should prepare for this rule to go into effect on January 1, 2015.
This means that in California, the current caregiver overtime rules will change. Currently agencies must pay overtime to personal attendants who work in private homes for work above 9 hours in a day and above 45 in a week. As of January 1, 2015, agencies will have to pay these same personal attendant caregivers working in private homes overtime for work above 9 hours in a day and above 40 in a week. This change could particularly impact live-in staffing and billing.
If you haven’t already done so, you should inform your clients NOW about the upcoming rate change. You also should revise your client service agreements, employment agreements and handbooks to reflect this change.” say Bob King

]]>Question –  Currently when we schedule a client, I print out a Plan of Care,  call the caregiver and have her pick up the hard copy before her scheduled date at the client’s home. Could I e-mail this Plan of Care to the caregiver instead?
Answer – The problem with emailing the Plan of Care is then you would have to comply with HIPPA, which in itself is a big pain.  The general rule is if you transmit any health information electronically, you must comply with HIPPA polices and procedures.  So emailing information is not necessarily a “can’t” but more of a “do you want to deal with the HIPPA regulations”  FYI – my understanding is that a fax does not count as an electronic communication.
